The Right of Children to Participate in Medical Decision-Making

Can minors decide what is in their interest, or do parents know better? While Art.1 of the UN Convention on the Rights of the Child defines children as “every human being below the age of 18 years”, most children are in a position to make decisions about their health earlier. In medical law cases, this can lead to difficult assessments of decision-making abilities. The “best interest” of the child (Art. 3 CRC) is usually what all parties involved strive for. However, the definition of “best interest” can be contentious, so that the courts have to balance all conflicting interests. This article aims to analyse the influence of the different parties involved in competing rights claims concerning children’s health. The following ‘best interest’ test will be used as a framework: D = ax + by + cz (D: judge’s decision, x: child’s preference, y: parents’ wishes and z: State’s interest).

This year’s Human Rights Watch Global Council Summit took place in Berlin between the 20th and the 22nd of June at the European School of Management and Technology. This conference addressed a wide spectrum of issues, from the refugee crisis, to the rights of the disabled, LGBT, women and children. Stagnation in der Sterbehilfedebatte in Europa

In der nationalen Sterbehilfedebatte gibt es Neuigkeiten: am 10.12.2015 ist in Deutschland der neue § 217 StGB, der die geschäftsmäßige Sterbehilfe verbietet, in Kraft getreten. Elf Tage später hat das Bundesverfassungsgericht den Antrag von vier Mitgliedern des Sterbehilfevereins, das Verbot außer Vollzug zu setzen, abgelehnt. Es ist jedoch nicht notwendig, sich vertieft mit dem neuen Gesetz und der aktuellen Rechtsprechung zu beschäftigen, um festzustellen, dass das Selbstbestimmungsrecht auf nationaler Ebene zunehmend Einschränkungen erfährt. Die aktuellen Entwicklungen sind jedoch ein passender Anlass dafür einen Blick auf die europäische Ebene zu werfen. Weiterlesen
